Body-worn cameras (BWCs) have, over the years, gradually become an integral part of the police's modern uniform. They are heralded as a revolutionizing technology, promising a new level of transparency, accountability, and an objective truth of events during law enforcement encounters. However, despite the promise, concerns have arisen over potential misuse and manipulation of BWC footage. This article critically examines instances and implications of police misusing body cameras.
When first introduced, BWCs were hailed as the panacea for police misconduct and public mistrust. Their primary objectives are to provide impartial evidence in contentious situations, deter bad behavior, train police officers, and document encounters with the public.
However, evidence increasingly points to a troubling trend indicating such cameras are not consistently utilized as envisioned. Instead, they are frequently becoming tools for selective recording, with usage often at the discretion of the officers.
Selective recording refers to instances where police officers choose to start or stop recording selectively, effectively controlling the narrative of events. This is a particularly dangerous form of misuse as it not only undermines the very purpose of BWCs – transparency and accountability – but also provides a manipulated version of the truth.
A study by the University of Cambridge found that police officers equipped with BWCs were 15% more likely to be assaulted than without. The study suggested that selective recording might create situations where only the reaction of the public, often at its worst, is captured, while the actions of the officer leading up to the reaction remain undocumented.
Beyond selective recording, several other categories of misuse come into play. One such category is the discretionary access and misuse of BWC data. This could range from unnecessary replay of graphic footage, leaking of sensitive data to public or media houses, to the deletion, or modification of important footage.
In 2017, two officers from the Metropolitan Police Department, Washington DC, were caught using their BWCs to reenact the discovery of a weapon at the crime scene, following a shooting - a glaring example of footage manipulation.
Violation of BWC protocol, such as selective recording, exudes serious consequences. On a broad scale, it erodes public trust and contradicts the cardinal intent of fostering transparency and accountability. It further undermines the integrity of court proceedings, as manipulated footage might serve as misleading evidence.
Institutional complicity in misuse is also a concern. A thorough policy structure guiding BWC usage is often absent. Enforcement of compliance checks and sanctions for misuse typically lack strength, indirectly fostering misuse.
The chilling case of Lulu Multi-Racial Unrest in 2015 illustrates this. There was widespread misuse of BWCs, with many officers failing to switch on their BWCs during crucial encounters. Despite this blatant protocol violation, no significant disciplinary action was levied.
Combatting misuse requires concerted efforts in technological improvement and stringent policy structure. There are calls for tech improvements to create tamper-proof BWCs, continuously recording devices, automatic activation features, and other means to limit officers' power over recordings.
However, technology alone isn't the panacea. A comprehensive overhaul of policy regarding BWC usage is vital. This would include non-discretionary rules on when to record, strict access protocols to BWC data, periodic audit and compliance checks, and prompt, stringent penalty systems.
The promise that BWCs have brought to the public's relationship with law enforcement is too great to be overshadowed by instances of misuse. Any system, however, has its challenges. The key lies in acknowledging the issues and proactively seeking to address them. As we continue to equip our officers with BWCs for the safety and trust of the public, we must also equip our policies and tech capabilities to ensure this tool serves its intended purpose.
