North Dakota, for example, does not yet have state-wide regulations regarding body cameras. Many of its law enforcement agencies cite the high costs and the intensive data management required as deterrents. However, they are not averse to their potential benefits regarding accountability and transparency and are actively pursuing reforms in this area.

The Privacy Conundrum

Beyond the financial implications, the deployment of body cameras also opens up a new sphere of issues: privacy concerns. Some states and privacy advocates caution against the "Big Brother" implications of always-on surveillance, contending that it could impinge upon the privacy rights of both officers and the general public.

In West Virginia, authorities share reservations on the impact of statewide body camera policies on individual privacy. Law enforcement agencies in the state believe that, without proper privacy guidelines, body cameras might indeed generate new privacy concerns over continuous surveillance, storage and accessibility of recorded data.

While a number of states still do not mandate police body cameras, it doesn't suggest a lack of concern for police accountability or citizen safety. Rather, it reflects a complex tapestry of considerations, encompassing financial, technological, and privacy concerns that these states are keen to address and reconcile.

In many states without comprehensive body camera policies, efforts are being undertaken to explore this territory. From pilot testing programs to commissioning studies on their feasibility and impact, states are innovatively approaching the future of policing.

To demonstrate, New Mexico was one of these states without a body camera policy, but in 2020, they passed a law requiring all state and local law enforcement officers to wear body cameras amidst national calls for police reform.

In order to tackle issues of cost, states are looking towards federal funding and assistance, investigating ways to effectively manage data storage without breaking the bank.
